Information Collection and Use:

Mind Map Media is the sole owner of the information collected on all of our family of Websites.

Registration, Join, Memberships, Win:

If you request a catalog, join our email, or sign up for our contest a user is required to give their contact information (such as name, address, and email address). We use this information to send the customer a catalog and/or marketing emails. We do not rent, lease, or distribute our customer’s email or mailing addresses to any companies. If you wish to remove your name this can be done by emailing our Support Team at [email protected]. Or, contact us by postal mail at the contact information listed below. If you submit a comment as part of the testimonial for a product, we will email you in accordance with any marketing promotions, special deals, new products, and maybe other companies products, but we will not provide your addresses to any other company. By submitting your information and comments, you authorize us to print your name and comments as a review for the product listed.


Ordering & Payment Options:

We request information from the user on our order form. A user must provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, and expiration date). This information is used for billing purposes, and to fill customers’ orders. If we have trouble processing an order, the information is also used to contact the user.

We accept Visa, MasterCard, American Express, Discover, and many other credit cards from the merchant account. Pre-payment may also be made by check, money order, or wire transfer. Orders cannot be shipped until the payment method is authorized and cleared.

Please note that shipments from the United States to other countries may involve taxes, import duties, customs-related fees, or other charges beyond our control, for which the recipient is responsible. Please contact the Service department for a wire transfer or pre-payment information.



Returns & Refunds:

At Mind Map Media LLC, we take your shopping satisfaction seriously. If you are not satisfied or have changed your mind, Mind Map Media LLC will accept most merchandise for return within 10 days of purchase and offer you the option to either replace the item or receive a refund. However, not all merchandise is eligible for return. Please note: a 20% re-stocking fee will be assessed for items that are ordered in error or are not "liked" by the customer. We suggest you read the return policy listed below before you make your purchase. We will be happy to help you meet these terms and conditions required in making an exchange or return.

Product Exchange:

Once we receive, approve, and process the returned item, you will immediately be authorized for a credit or a replacement, with a tracking number.


Crediting Your Account:

A credit will be issued within 2 business days of receipt of your return and will be issued to the account that was originally charged. Shipping and handling fees are non-refundable unless we have made an error. Please note that your financial institution may take up to 10 additional days to post the credit to your account. When returning an item paid for by check or money order, a refund check will be mailed to you within 10 business days from the time we receive your return.


Refused Packages:

If we do not advise you to refuse a package and it is not damaged in shipping, a 20% restocking fee may be charged to your account. This fee is assessed to cover our restocking & processing fees.


Returns on "Clearance" Items:

If the product is damaged or defective, returns on "clearance" items will be accepted within 30 days of the invoice date. We may not exchange "clearance" items if the manufacturer has either discontinued these items or they are no longer available.


General Policies:

Non-defective returns will be shipped at the customer’s expense, and a 20% restocking fee may be assessed.

We must receive the returned package within 14 business days of the RMA issue date.

Discontinued items are not eligible for return or exchange.

All products are sold with the respective manufacturer’s warranties. Please note that warranty periods and services vary by manufacturer and product.

When returning products, we strongly recommend using a carrier that can track packages. The customer assumes responsibility for insuring returned items.

Items weighing 150 lbs. or more need to be coordinated through our Service Department.

No returns will be accepted without original packing material and documentation. All items must be returned in "new" condition including all accessories, blank warranty cards, UPC codes (attached), and user manuals.

We are not liable if you order the wrong product.

We offer many different products and provide manufacturer part number information and some technical specifications to assist in your buying decision, we may not offer technical support but we will assist you to make your purchase from us, the most satisfying event possible.

Exceptions to Our Return Policy:

Please note that certain manufacturers’ products are not eligible for return or exchange through us. Certain manufacturers require that they handle their damaged or defective products themselves. These products are noted in the individual manufacturer’s online catalog store. 


Cancellations:

If for any reason you wish to change or cancel your order, please notify us as soon as possible. We are happy to accommodate requests for changes or cancellations as long as we receive them before the order has been sent out for delivery or prepared for shipment. Twenty-four-hour advance notice is necessary to assure a cancellation or any changes to your order. An order cannot be canceled or changed after it has been sent out for delivery.

In the event an order must be canceled we may charge 20% of the order's total and refund the rest of the sum paid. In case of incomplete or incorrect address, information, or phone numbers resulting in non-delivery, we may charge you for the additional costs of the second delivery. If you cancel at this time, a 35% cancellation charge may be assessed. We will always work with you to make your shopping experience a pleasant endeavor.

Free Ground Shipping is our only option available. We deliver to all areas in the Continental United States. We do not ship to Alaska, Hawaii, Puerto Rico, or any International location. All free ground shipping may be delivered by UPS, FedEx, or USPS Ground.

You may ask for or offer to pay more for faster shipping, as we really hate to say NO, but we do not deliver any other way but Free Ground Shipping.

We do our best to ship within three [3] days. Orders after 4:00 p.m. EST (1:00 p.m. PST) may not be shipped within the stated time frame. We do not process orders on Saturdays, Sundays, and national holidays.

Orders will be processed and shipped pending credit card authorization or if paying by check or money order, payment must clear the bank. Mind Map Media LLC cannot be responsible for shipping delays due to a declined credit card, incorrect billing or shipping address, billing information not being submitted through our website, or failure to provide a correct street address.We are also not responsible for delays caused for any reason.

Log Files:

Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and the number of clicks to analyze trends administer the site, track user movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses are tied to personally identifiable information to enable our Web-based service. We use log files and analytics to analyze user movement.


Clear Gifs:

We may employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs). Clear gifs are tiny graphics with a unique identifier, similar in function to cookies (see the security & privacy section), and are used on the final shopping cart page to track sales for marketing programs. The main difference between the two is that clear gifs are invisible on the page and are much smaller, about the size of a period at the end of a sentence. Clear gifs are not tied to users’ personally identifiable information.

In addition, we use clear gifts in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. Communications from the Site:

Special Offers and Updates will occasionally be sent for information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users, we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.

Service Announcements on rare occasions will be sent. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt out of these communications. However, these communications are not promotional in nature.

Business Transitions:

For example, our order form has an ‘opt out’ mechanism so users who buy a product from us but don’t want any marketing material can keep their email addresses off of our lists.

Our family of websites may request information from users via contests. Participation in this contest is completely voluntary and the user, therefore, has a choice whether or not to disclose this information. Contact information will be used to notify the winners and award prizes. Users’ personally identifiable information is not shared with any other company.


Email-A-Friend:

If a user elects to use our referral service for informing a friend about our website, we ask them for the friend’s name and email address. Terms & Conditions:

We require that you agree to the following terms & conditions upon agreeing to use any of our Digital Marketing service plans.Mind Map Media (we, us) and Client (you) agree to the following:

1. Definitions:

(a) "Client" means the person who orders services from us and has ownership rights to the "Web Site".

(b) "Web Site" means all data files, data structures, images, and other information content owned by the Client that is to be hosted and managed under this Agreement.

(c) "Physical Server" means the third-party computers, hardware, operating system, and software necessary to operate and support your Web Site in accordance with this Agreement.

2. Payment Terms:

You agree to the following payment terms in consideration for the services provided:

(a) Initial Fees. You will pay us 50% of the initial set-up fees, with 50% due at 45 days upon completion of the initial set-up, then once each year based upon agreement, non-refundable initial set-up fees according to our agreed upon costs.

(b) Service Fees. You will pay us in advance for monthly Service Fees, for each service we provide under the Agreement according to our agreed-upon costs. Monthly Service Fees are billed to you on the 15th of the current month and are due on the 1st day of the month in which the Service Fees work is to be accomplished. If you begin using our services after the first of the month, we will prorate your first month's Service Fees paid in advance. Service Fees are subject to adjustment, with notice, according to our agreed-upon costs.

(c) Cancellation. In the event you cancel any service, you will be charged in full for the entire month in which you canceled your service.

(d) Breach. In the event we terminate this Agreement because of a breach, you will be charged in full for the entire month in which the breach occurred for services.

(e) Taxes. Service fees are exclusive of any and all federal, state, and local sales, use, value-added, excise, duty, and any other taxes assessed with respect to the services provided under the Agreement, except that any sales or similar taxes on the sale of Client products and services to end users shall be the sole responsibility of the Client.

3. Representations and Warranties:

Our obligations under the Agreement are conditioned upon the following representations and warranties:

(a) Authority to Contract. You represent and warrant that you have full authority and right to enter into the Agreement and that there are no conflicting claims relating to the rights granted by this Agreement.

(b) Non-Infringement. You represent and warrant that your performance of the Agreement and providing any content for your Web Site, shall not infringe the intellectual property or other proprietary rights of any third party.

(c) Disclaimer of Warranties. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED ABOVE, WE MAKE NO WARRANTY RELATING TO THE SUBJECT MATTER OF THE AGREEMENT, AND ALL SERVICES ARE PROVIDED ON AN "AS-IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, OR MARKETABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR OF NON-INFRINGEMENT.

4. Risk:

You expressly agree that the use of our hosting service is at your own risk. Neither we, our employees, affiliates, agents, third-party providers, merchants, licensors, or the like, warranty that our service will not be interrupted or error-free; nor do we make any warranty as to the results that may be obtained from the use of our services or as to the accuracy, reliability or content of any information serviced or merchandise contained in or provided through our services, unless otherwise expressly stated in the Agreement.

Under no circumstances, including negligence, will we, our officers, agents or anyone else involved in creating, producing, or distributing our services be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use our services. We will further not be liable for results from mistakes, omissions, interruptions, deletions of files, errors, defects, delays, and operation, or transmission or failure of performance whether or not limited to acts of nature, communication failure, theft, destruction or unauthorized access to our records, programs or services. You acknowledge that this paragraph shall apply to all content on your Web Site.

5. Term and Termination:

The following describes the effective date, duration, and methods of termination:

(a) Duration. This Agreement will commence on the date as appearing at the top of the Agreement document and continue until termination.

(b) Termination for Convenience. Subject to Section 3.3, you may terminate the Agreement at any time for your convenience by providing us with 15-day advance notice.

(c) Breach or Default. The following constitute a breach or default of the Agreement:

*your failure to pay the current month's Service Fees by the first day of the month, your violation of Sections 3(a) and 3(b),

*your violation of Section 7,

*your violation of 8(c).


6. Ownership Rights:

We acknowledge that all rights, titles, and interests in the website shall be solely owned by the Client.

7. Activities Subject to Immediate Deactivation:

Any Web Site that is used for Illegal, Abusive, or Unethical Activity may be immediately deactivated by us without warning to you.

Illegal, Abusive, or Unethical Activities include, but are not limited to, pornography, obscenity, nudity, violations of privacy, hacking, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by us.

You agree to indemnify and hold us harmless from any claim resulting from your publications or use of Illegal, Abusive, or Unethical materials.

Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 12-hour period after discovery, we are not required to give notice before deactivating your use of our services if, at our discretion, your use is or results in Illegal, Abusive or Unethical activities.

If a Web Site is disabled, the regular monthly fees still apply.


8 Miscellaneous:

(a) Public Nature of the Internet. All information submitted on your Website shall be considered publicly accessible. Important and private information should be protected by you. For example, we are not liable for the protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use.

(b) Governing Law and Attorneys' Fees. The Agreement will be interpreted and applied in accordance with the laws of the state of Washington, without regard to the conflicts of law provisions.

(c) Age. You certify that you are at least 18 years of age.

NOTE: YOUR SIGNATURE ON A PRINTED COPY OF THE AGREEMENT IS NOT REQUIRED IN ORDER FOR THE AGREEMENT TO BE LEGALLY BINDING ON YOU. YOUR USE OF OUR SERVICES SHALL CONSTITUTE A VIRTUAL SIGNATURE, HAVING THE SAME FORCE AND EFFECT AS IF YOU HAD ACTUALLY SIGNED A PRINTED COPY OF THIS AGREEMENT.
